Foto IA generates professional photos from user-provided selfies. Our system creates a personalized AI model for each user and produces a variety of photos in different styles and scenarios.

4. Service Usage

  1. Eligibility: You must be of legal age in your jurisdiction to use Foto IA.
  2. User Account: You are responsible for maintaining the confidentiality of your account and password.
  3. Acceptable Use: You agree not to use Foto IA for illegal or unauthorized purposes.
  4. User Content: By uploading selfies, you guarantee that you have the right to do so and grant us permission to use them in creating your personalized AI model.

5. Intellectual Property

  1. Our Rights: Foto IA and its original content are protected by intellectual property laws.
  2. Your Rights: You retain rights to the selfies you upload. For AI-generated images, we grant you a worldwide, non-exclusive, royalty-free license to use, copy, modify and distribute these images.

6. Limitation of Liability

  1. The service is provided "as is" and "as available". We do not guarantee that the service will be uninterrupted, timely or error-free.
  2. We are not responsible for any misuse of generated images or any consequences resulting from your use of Foto IA.

7. Service and Terms Modifications

We reserve the right to modify or discontinue Foto IA at any time. We may also update these Terms occasionally. Changes will take effect immediately after publication on our website.

8. Payments and Subscriptions

  1. Payment Processing: We use Stripe as our payment processor. By making a purchase, you accept Stripe's terms of service.
  2. Subscription Management: You can manage your subscription, including cancellation and updates, through Stripe's customer portal. You can access this portal at any time through your Foto IA account.
  3. Automatic Cancellation: If you cancel your subscription, you will continue to have access to the service until the end of the current billing period. After that period, your subscription will be automatically cancelled.

9. No Refund Policy

  1. Due to the nature of our service and the high costs associated with artificial intelligence image generation, Foto IA does not offer refunds for services provided.
  2. By making a purchase or using our service, you acknowledge and accept that the transaction is final and non-refundable.
  3. We strongly recommend that you carefully review your order before confirming it, as we will not be able to process refund requests once the image generation process has begun.

10. Account Cancellation

  1. You may cancel your account at any time through Stripe's customer portal or by contacting us at [email protected].
  2. Cancellation of your account will not result in any refund for services already provided or in process.
  3. We reserve the right to cancel or suspend your account at any time if you violate these Terms and Conditions.

11. Applicable Law

Business activity is governed by French legislation (micro-entreprise registered in France).

For website use and services offered to Spanish users, Spanish consumer protection and electronic commerce legislation will apply as appropriate.
